Questions were raised recently with respect to eight (8) hour payments when engineers and conductors work their second relief day and are unable to work the first day of their regular assignment, when this rest period is also a 24 hour rest period under the hours of service law.
There was some confusion with respect to allowing “013” payments for a 24 hour rest period. Verification was allowing payments when the employee was unable to work their assignment if the employee had under eight (8) hours rest between being off duty on their second relief day and the start of their regular assignment. This practice was stopped several weeks ago. Verification was properly not allowing payment when the employee had more than eight (8) hours after finishing their assignment on their second relief day, and they are unable to work their regular assignment due to requiring 24 hours rest.
We discussed with both the UTU and the BLE and advised them that we would continue to make these payments as they have been made in the past. Meaning, we will allow payments when an engineer or conductor is unable to work the first day of their regular assignment, if the time after finishing their job on their second relief day and the start of their regular assignment is under eight (8) hours.
